General conditions of use

ING Real Estate does not charge the user for the use of the website. 

1 ING Real Estate may, as necessary, temporarily disable or restrict access to the website for maintenance or other purposes, informing the user at the time of accessing the website. Users are not entitled to uninterrupted availability of the website. 

2. The user is obliged to use the website exclusively for personal, non-commercial use and, in particular, not to use any programs or functions to automatically generate page views or content on the website or to automatically copy content from the website.

3. Any processing of personal data will be carried out in accordance with the provisions of the EU General Data Protection Regulation ("GDPR") in the version applicable from May 25, 2018, and in particular the statutory data protection provisions of the German Federal Data Protection Act (BDSG). In order to conclude a contract, the user must provide their personal data, which will be used to process the reservation. Mandatory data required for contract processing are marked separately; other data are voluntary. ING Real Estate processes the data provided to process the reservation. For this purpose, payment data may be transmitted to ING Real Estate's own bank. The legal basis for this is Art. 6 para. 1 p. 1 lit. b GDPR. They contain detailed information on how personal data is processed, how it is protected, and what rights the customer has in this regard.

The User is entitled to any legal guarantee. All legal relations between ING Real Estate and the User shall be governed exclusively by the laws of Spain, excluding any conflict of laws provisions of private international law. If the User is a consumer, sentence 1 shall only apply to the extent that the choice of law does not impair the protection of mandatory legal provisions of the state in which the User has his or her habitual residence.

The prices indicated in the corresponding offer are total prices and include taxes and fees.

The language available for contract execution is Spanish. Our reservation confirmation and provision of additional information are made exclusively in Spanish.

Notice concerning consumer arbitration proceedings pursuant to Section 36 of the Consumer Dispute Resolution Act (VSBG) and online dispute resolution pursuant to Article 14(1) of the Regulation on Online Dispute Resolution for Consumers (Regulation (EU) No 524/2013; referred to as the ODR Regulation).

We use the information we hold about you internally as follows:

• We will use the information you submit for the purposes for which you provided it, including, for example, to create and maintain a Service account for you or to answer a question you may have.

• We use submitted and collected information to provide the Service to you.

• We use submitted and collected information to customize the content you and others see based on personal characteristics or preferences. This may include highlighting or emailing you about listings we believe are most likely to be of interest to you. 

• We may analyze information collected in connection with your use of the Service to help us improve the Service and develop and improve other products and services. 

• We may use submitted and collected information to help troubleshoot problems, provide you with necessary notices, enforce our User Agreement (for example, when necessary to protect our or a third party's intellectual property or property rights), or alert you to changes to our policies or agreements that may affect your use of the Service.

We use and disclose the information we maintain about you as follows:  

• Certain information, including personally identifiable information such as your name and information received through your social media account, will be disclosed to other Service users as part of your Service profile. You can view this information by viewing your own profile. 

• When you post a review of a property, including your location, that review will be visible to all other users of the Service. This means that when you post a review of your residence, other users will know where you live.

• When you view a listing on the service, the person who posted the listing will be able to see that you have viewed the listing.

• If you respond to an offer from a rental property owner or landlord for which you may receive a referral payment or other reward, we will provide your name and contact information to the owner or landlord. If you sign a lease or move into a rental property in connection with your use of the Service, or engage in any other activity on the Service for which any other user is eligible to receive a referral payment or reward, such users will be aware that you have signed the lease, moved in, or engaged in the activity. 

• If you link a Social Service to your Service account, we will use the information and materials we receive from the Social Service to complete your Service profile, including your name, email address, and profile picture. We may also use such information to connect you with your friends and contacts through the Service. 

• We may provide you with the ability to share your Service account profile or other information related to your use of the Service on a social site or other websites or online services. If you choose to participate in such sharing, please be aware that your submission of such information will be subject to the privacy policies and practices of the applicable social site, website, or online service, and that we cannot control how third parties who access such information may use or disclose it. 

• We may disclose non-personally identifiable information to third-party partners to further our business dealings with them, including, but not limited to, offering you a joint product or service or creating interoperability between our products and services and the products and services of such partners.

• We may provide advertisers and other third parties with non-identifiable aggregate information about our user base and their usage patterns.

• The Company uses third-party contractors and service providers to provide the Service to our users. When our contractors or service providers gain access to your information, they are required to protect this information in a manner consistent with this Policy, for example, by not using it for any purpose other than performing the services they are performing for the Company.

• We will use and disclose information when we, in good faith, believe that the law or legal process (such as a court order, search warrant, or subpoena) requires us to do so, or in other circumstances when necessary to protect the rights or property of the Company, our users, or third parties.

5. Advertising . The Service may include advertising provided by third-party advertising service providers. These providers and their partners may use cookies, beacons, and other technologies in connection with the targeting, serving, and performance measurement of their advertising, including for the purpose of targeting ads based on users' browsing behavior.

6. Review and Modification of Information . You may log in to your Service account and view and change your user account information at any time, although information originating from your Social Account may only be changed through the use of your Social Account. 

7. Choices Regarding Third-Party Offers . To the extent we send you commercial emails about third-party marketing or promotional materials, we will give you the opportunity to opt out of receiving such emails in accordance with applicable law. We will not provide your personally identifiable information to third parties for their own marketing purposes without your consent.

8. Security . The personally identifiable information we collect about you is stored on servers with limited access. We will maintain reasonable security measures to protect the security of these servers and your personally identifiable information. However, no security measures are 100% effective, and we cannot guarantee the security of your personally identifiable information. 

9. Transfer as a Corporate Asset . In the event of a merger, sale of capital or assets, reorganization, consolidation, or similar transaction involving the Company, the information we hold (including personally identifiable information) will be transferred as a corporate asset to the acquiring entity, provided that such entity will continue to treat such information in accordance with this Policy. 

10. Transfer to the U.S. or other countries . The Company is established and operates facilities in the United States. Your information will be stored and processed in the United States or other countries where the Company maintains facilities. By using the Service, you consent to the transfer of information outside of your country, even if your country has more stringent data protection standards.
